Senate deal could affect recess appointment case

WASHINGTON (AP) ? The Senate's deal to avert a showdown over its internal rules and confirm several long-stalled Obama administration nominees could upend a major case at the Supreme Court, one that would test the president's power to use recess appointments to fill high-level posts.

The case is shaping up as a major clash between President Barack Obama and congressional Republicans over the power granted the president in the Constitution to make temporary appointments to fill positions that otherwise require confirmation by the Senate, but only when the Senate is in recess.

Obama had sought to overcome Senate Republicans' refusal to allow votes for nominees to the National Labor Relations Board and the new Consumer Financial Protection Bureau by making recess appointments. Two federal appeals courts have said Obama overstepped his authority because the Senate was not in recess when he acted. Those courts invalidated actions of the NLRB as a result.

The Supreme Court is set to consider one of those cases around the end of the year, involving a dispute between a Washington state bottling company and a local Teamsters union in which the NLRB sided with the union. The U.S. Circuit Court of Appeals for the District of Columbia overturned the board's ruling.

But now that the Senate is on the verge of breaking the logjam that led Obama to make the recess appointments in the first place, his administration may find its appetite diminished for a major high court case. That may be especially so because the justices have been more skeptical of Obama's Justice Department than its predecessors and the court's conservative majority has been hostile to union interests.

The administration would have to ask the court to dismiss the case, although that almost certainly would leave the appeals court decision in place. The Justice Department did not respond to a request for comment Tuesday.

The justices also might now see less urgency to decide the questions at issue ? what is a recess, when must vacancies occur to be filled through recess appointments and can the president override Congress' own view of what constitutes a recess.

In some instances, the new NLRB appointees contemplated in the Senate agreement could re-enact some of the earlier decisions, removing any potential taint. The NLRB did just that following a Supreme Court decision in 2010 that invalidated actions taken by only two members of the five-person board. One significant limitation is that the NLRB would have to get judges to relinquish cases currently in the courts.

"One key aspect of constitutional law is the notion of not deciding unnecessary questions, and it may be that the agreement today provides an avenue for the CFPB and NLRB to revisit their decisions and sidestep the constitutional questions at issue in the Supreme Court's recess appointment case," said Neal Katyal, former acting Solicitor General under Obama.

The case stems from Obama's decision to fill the three NLRB vacancies on Jan. 4, 2012, with Congress on an extended holiday break. At the same time, however, the Senate held brief, pro forma sessions every few days as part of the Republicans' explicit strategy of keeping Obama from filling vacancies through recess appointments.

If the justices ratify the lower court ruling, it would make it nearly impossible for a president to use the recess power, giving the opposition party in Congress the ability to block administration nominees indefinitely. And more than 1,600 NLRB decisions could fall in the process.

Rachel Brand, a senior lawyer with the U.S. Chamber of Commerce, said she hopes the court decides the case in favor of the bottling company. With hundreds of other legal challenges pending to NLRB decisions, Brand said it "would be a mess to re-litigate" those cases if the justices were to punt on the case before them.

The head of a think tank that is opposed to the chamber on the recess appointments issue said he also wants the high court to remain in the case and overturn what he sees as a damaging appeals court ruling. "The fact that Congress has now cleared the way for the board to be fully staffed with Senate-confirmed members in no way changes that calculus," said Douglas Kendall, president of the Congressional Accountability Center.

In addition to the two rulings against Obama recess appointees, three federal appeals courts have upheld recess appointments in previous administrations.

For all the Democratic complaints about Republican obstruction of the president and GOP anger over Obama recess appointments, the subject is acutely susceptible to changing political fortunes.

The parties' roles were reversed when a Republican president, George W. Bush, was in the White House and Democrats controlled the Senate in the final two years of his presidency. Then, Senate Majority Leader Harry Reid employed the same tactic of convening the Senate every few days to keep Bush from filling vacancies through recess appointments. Unlike Obama, Bush did not press the issue.

If the Supreme Court doesn't settle it now, the issue could arise again while Obama still is in office. Or the court could await a future president of either party facing a determined Senate opposition.

Michael Bay and Paramount Pictures jointly announced today that Chinese entertainer Han Geng has been cast in "TRANSFORMERS 4." Among Asia's top stars, Han Geng has conquered the worlds of music, television and feature film to become one of the most influential entertainers in China.

He joins Mark Wahlberg, Stanley Tucci, Kelsey Grammer, Jack Reynor, Nicola Peltz, Sophia Myles, TJ Miller and Chinese actress Li Bingbing in the fourth installment in the hit series of movies based on the best-selling Hasbro toyline. Paramount Pictures will release the film on June 27th, 2014.

"Han Geng has been a sensation in China and we are happy to have him in our movie," said Michael Bay.

Making his debut in 2005 as a member of the hugely popular group Super Junior, Han Geng later turned to a solo career, releasing his first album "Geng Xin" in 2010, which went on to sell over a million copies. His most recent album "Hope in the Darkness" was released in 2012 and has earned Han Geng a number of hit singles.

Han Geng has appeared on both the big and small screen, with roles that have shown his range as an actor. In 2008, Han Geng appeared in CCTV's "Stage of Youth," a 12-episode drama that drew incredible ratings. Among his big screen roles, he had a cameo appearance in the 2010 feature film "The Founding Party," along with other A-list Chinese celebrities and later that year had his first starring role on the silver screen in the action movie "My Kingdom". The multi-hyphen entertainer has subsequently starred in the films "Beginning Of The Great Revival," and "The First President." His most recent starring role was in "So Young", a major box office hit in China, having earned more the $115 million (over 700 million yuan) since its release in May of 2013.

Han Geng has extraordinary popularity on the internet in China. When his albums or films are released his name and movies typically top the charts as the "most searched" and accumulate the most hits. "TRANSFORMERS 4" marks Han Geng's debut in an English language production.

    (AP) ? Talk about grade inflation.

    Graduate student Megan Thode wasn't happy about the C-plus she received for one class, saying the mediocre grade kept her from getting her desired degree and becoming a licensed therapist ? and, as a result, cost her $1.3 million in lost earnings.

    Now Thode is suing her professor and Lehigh University in Bethlehem, claiming monetary damages and seeking a grade change.

    A judge is hearing testimony in the case this week in Northampton County Court. Lehigh and the professor contend her lawsuit is without merit.

    Thode took the class in fall of 2009. Her instructor, Amanda Eckhardt, testified this week that she stood by the grade, saying Thode failed to behave professionally and thus earned zero out of 25 points in class participation, bumping her down a full letter grade.

    "I ... believed she received the grade she earned," Eckhardt said.

    The C-plus prevented Thode, an otherwise A student, from going on to the next class and advancing in her professional therapist studies, according to The Express-Times of Easton. She wound up getting a master's degree in human development instead.

    Her attorney, Richard Orloski, argued Eckhardt targeted Thode because she is an outspoken advocate for gay marriage. Eckhardt testified that while she believes marriage is between a man and woman, she would never allow her personal views to influence her treatment of students. She said Thode had outbursts in class, did not participate appropriately, was emotionally unstable and failed to heed a warning letter.

    Stephen Thode, the plaintiff's father and a longtime finance professor at Lehigh, testified on his daughter's behalf and said her participation score was highly irregular.

    "I have never heard of a case, not just at Lehigh, where a student achieved a zero in class participation where they attended and participated in every class," he said.

    Northampton County Judge Emil Giordano is presiding over the nonjury trial and will issue a ruling on Thode's lawsuit after testimony concludes.

    Way back in 2010, filmmaker Simon Klose petitioned folks on Kickstarter for $25,000 to hire a professional to video editor. The pro's task? Sifting through and editing over 200 hours of footage Klose had recorded that chronicles the journey of The Pirate Bay's three founders throughout their trial. Now, over two years later and after the case's conclusion, the documentary has premiered at the Berlin International Film Festival and is now available for your viewing pleasure. Sure, you could watch the whole hour and twenty minute-long affair in 1080p on YouTube, but what would be more fitting than legally downloading it (thanks to a creative commons license) through The Pirate Bay?     (AP) ? Chiney Ogwumike is used to posting big numbers on most nights. Mikaela Ruef surprised herself by nearly matching Ogwumike.

    Ogwumike had 18 points and 12 rebounds for her seventh straight double-double, leading No. 4 Stanford past Arizona 73-43 on Friday night. Ruef scored 11 points and had 10 rebounds for her first career double-double.

    "It was weird. I thought I'd never score 11 points in a game," said Ruef, a high school Gatorade Player of the Year in Ohio. "That's way too much. Normally it is not my job to score."

    Stanford coach Tara VanDerveer has been pushing for the rest of the team to become offensive contributors in an attempt to ease the pressure on Ogwumike.

    Ruef listened.

    "Tara told me to be confident in my moves when I got into position on the block," Ruef said. "I didn't know I had any moves, but I did want to be confident when taking a shot."

    Joslyn Tinkle added 15 points, including a 3-of-4 effort from long range, for the Cardinal (21-2, 10-1 in the Pac-12), who won their seventh straight.

    "We can't just be a one-trick pony," VanDerveer said. "We can't be all about Chiney. When people play with Chiney, she makes it look so easy. Others need to assert themselves more. Mikaela got in deep and scored against them."

    Alli Gloyd scored 13 points to lead the Wildcats (11-11, 3-8 Pac-12), who lost their sixth straight and have dropped eight of 10 overall since opening the season 9-3.

    "We didn't play very well," Arizona coach Niya Butts said. "I think we did some good things defensively, but we just couldn't score. We were missing layups in the paint."

    Ogwumike missed three of her first four shots, allowing Arizona to remain within striking distance midway through the first half. She made four of her next five shots, however, coinciding with a 17-6 run that gave Stanford a 31-19 halftime advantage.

    Stanford has held its last 41 opponents to less than 70 points, an ongoing school record.

    Davellyn White, the Pac-12's active scoring leader, was held below 10 points for the first time this season, and the first time since last year's matchup with Stanford, a span of 31 games. She has 1,932 career points.

    "She plays so hard and she's always hitting the floor," Butts said. "She's banged up at the moment, but she will be OK. She's played through a lot."

    White did set a school record with her 119th career start. She had been tied with Dee Dee Wheeler.

    The Wildcats were able to force the Cardinal into a season-high 19 turnovers, but also turned the ball over 19 times themselves.

    "We dropped passes and we didn't finish," Butts said. "We missed a lot of opportunities."

    The Cardinal eventually built a 20-point advantage within the first six minutes of the second half and cruised the rest of the way, beating the Wildcats for the 22nd consecutive meeting. Arizona last beat Stanford in 2004.

    Stanford played without starting guard Toni Kokenis, who sat out as a precaution for an undisclosed illness.

    The Cardinal, who lead the conference in three-point field goal percentage defense, limited the Wildcats to 1 of 14 from long range.

    (AP) ? The Knights of Malta, one of the most peculiar organizations in the world, is marking its 900th birthday with a colorful procession through St. Peter's Square, a Mass in the basilica and an audience with Pope Benedict XVI.

    The Knights are at once a Catholic religious order, an aid group that runs soup kitchens, hospitals and ambulance services around the globe, and a sovereign entity that prints its own passports and enjoys diplomatic relations with 104 countries ? yet has no country to call its own.

    Some 4,000 people ? volunteers and members, draped in their trademark black cloaks with a white, eight-pointed Maltese Cross on the front ? processed through St. Peter's Square Saturday for the Mass marking the 900th anniversary of the order's recognition by the Holy See.

    S.Africa's rand edges higher ahead of manufacturing data

    JOHANNESBURG (Reuters) - South Africa's rand was slightly firmer against the dollar on Thursday but continued to look vulnerable ahead of the release of manufacturing production figures later in the day.

    The rand was at 8.8930 to the dollar at 0632 GMT, slightly firmer than Wednesday's New York close.

    Statistics South Africa will release manufacturing production data for December at 1100 GMT, figures that are expected to provide an indication of the health of Africa's biggest economy.

    "Another poor performance by the manufacturing sector would only confirm and further highlight the level of structural imbalances in the economy and why the rand as a currency is likely to remain vulnerable," Tradition Analytics said in a note.

    Although figures released on Tuesday showed that unemployment fell to 24.9 percent in the fourth quarter of 2012, from 25.5 percent in the third quarter, economists have pointed out that the news was not as positive as it appeared.

    Some 68,000 jobs were lost overall, Tradition said, but because the decline in the "economically active" population was greater, the unemployment rate eased.

    "This data is nothing to be proud or excited about," the analysts wrote.

    Reports on Wednesday that South African farmers had started laying off thousands of labourers two days after the government raised the minimum wage for the sector by 50 percent also highlighted the worsening economic backdrop.

    The layoffs are in addition to 14,000 planned job cuts announced by Anglo American Platinum last month.

    Government bond yields fell, dropping 3 basis points on the 2026 issue and 2 basis points on the 2015 paper.

    German bin-divers get connected to wage war on food waste

    BERLIN (Reuters) - Just past midnight behind a Berlin supermarket, two youngsters with torches strapped to their woollen hats sift through rubbish bins for food that is still edible, load their bikes with bread, vegetables and chocolate Santas and cycle off into the darkness.

    It is not poverty that inspires a growing number of young Germans like 21-year-old student Benjamin Schmitt to forage for food in the garbage, but anger at loss and waste which the U.N. Food and Agriculture Organisation estimates at one-third of all food produced worldwide, every year, valued at about $1 trillion.

    In environmentally aware, cost-conscious Germany, "foodsharing" is the latest fad, using the Internet to share food recovered from supermarket bins while it is still in good condition.

    "Dumpster-diving" for society's cast-offs is a fast-growing phenomenon among sub-cultures in Europe and the United States and "freegans" - vegans who do not believe in paying for food - have long been sifting through supermarket wheelie bins.

    But the "foodsharing" movement that has sprung up in cities like Cologne and Berlin brings efficiency and technical skills to the table in ways that make it uniquely German.

    More than 8,200 people across Germany have registered to share food on the www.foodsharing.de website in just seven weeks of existence, said Berlin organiser Raphael Fellmer.

    The website - which has an appropriately recycled-paper look - advises people where there are "baskets" and what is in them: organic sausages in Cologne or spaghetti and Darjeeling tea in Chemnitz. Members can log in or use a Smartphone app to see the address of nearby baskets or a pick-up time and place. They can then rate the transaction like ordinary online retailers.

    For people who cannot afford the Internet, Fellmer has set up the first of what he hopes will be many "hot spots" where food can be picked up anonymously: a fridge at a covered market in Berlin's Kreuzberg, where anyone can help themselves to food.

    "I've come for some bread rolls, just a couple," said Frank, an unemployed 47-year-old, who was alerted to the location of a hoard of fresh bread on the website and called at Fellmer's house.

    Opening his rucksack, he helped himself from a bag of rolls that had been on sale at a nearby bakery till 7 p.m. the previous evening.

    TASTE THE WASTE

    Throwing away food is a rich country phenomenon but a poor country's problem.

    Camelia Bucatariu, a policy expert on food waste at the FAO in Rome, said North American and European consumers waste 95-115 kg of food per capita a year, compared to just 6-11 kg in sub-Saharan Africa and southeast Asia. As economies develop, the level of food waste grows, said Bucatariu, who is Romanian.

    The foodsharers' argument that the tonnes of food wasted in Germany could feed people in poor countries is not as simplistic as it sounds: less waste means less drain on resources in the producer countries and less upward pressure on prices, she said.

    "It is not only wasting an apple, but wasting the resources embedded in that apple which may be produced outside of Europe," Bucatariu told Reuters. As well as economic damage there is the cost to the environment of using energy to grow food that ends up in a landfill site, emitting greenhouse gases like methane.

    The FAO is studying how to change such behaviour and whether changes are needed to legislation on the retailers' "date marks" differentiating "Best By" from "Use By" - the latter being the date when food may start to become a biological hazard.

    Fellmer is on a three-year-old "money strike": he does not earn or spend a euro and he, his wife and child eat only food that has been rescued from the bins.

    A rangy 29-year-old in a baggy blue jumper with spiky blond hair and a pointed beard, he is already something of a German media phenomenon. On a recent visit, a TV documentary crew and a reporter from a local daily were crowded into his one-room flat.

    He plonks on the table a packet of ginger biscuits for Christmas - from a batch of hundreds fished out of bins nearby - bearing a "use by" date which is still a month away. They taste fine, as do some red and gold-wrapped chocolate Santas.

    The "use by" dates infuriate the foodsharers, many of whom were first inspired by the 2011 film "Taste the Waste" by their guru Valentin Thurm.

    It documents waste ranging from farmers discarding tomatoes that are not red enough to bakeries burning the excess bread they made to keep the shelves looking full until closing time.

    Fellmer's friend Schmitt was brought up in a "very food-conscious vegetarian household". His mother is a food chemist who advises him on hygienic ways to eat and share food from plastic sacks that he admits are sometimes "mushy" under your fingers in the dark.

    Like Fellmer, he lives not in east Berlin, with its history of squats and communes, but in the leafy western suburb of Dahlem where he bin-dives under the noses of the German capital's most affluent residents.

    Foodsharing appeals to the "hipster" culture of Berlin with its tradition of anti-establishment protest, Schmitt said.

    The German crowdsourcing techniques could turn out to be "best practice" for reducing waste in other countries too, said the FAO's Bucatariu.

    "Solutions may vary according to the culture, the context and to what access to food there is," she said. "But each and every one of us can do something."

    Group urges Lebanon to protect Syrian refugees

    BEIRUT (AP) ? Lebanon has failed to enact political reforms to curb human rights abuses, promote women's rights, and protect migrants and refuges as the country grapples with spillover effects from civil war in neighboring Syria, an international human rights group said Thursday.

    Human Rights Watch hailed the Lebanese government for keeping its borders open for tens of thousands of Syrians who fled their homes because of fighting between rebels and government troops. However, the U.S.-based watchdog called on authorities to do more to protect refugees from being detained by security services or deported despite a risk of persecution by the Syrian regime.

    Lebanon has experienced an unprecedented influx of refugees from the Syrian conflict, which started nearly two years ago. Unlike in Turkey and Jordan, where Syrian refugees find shelter in camps, most Syrians in Lebanon live with host families, often in difficult circumstances and with very limited resources.

    Nearly 100,000 Syrians have registered with U.N. refugee agency in Lebanon, although the registration does not grant them legal status in the country, meaning that they risk detention and deportation. Given the influence Syria and its feared security services have wielded in the country over past decades, many Syrians, particularly those who support the opposition, feel unsafe in Lebanon. They live in fear of being repatriated, the rights group said, despite the risk of retribution.

    Lebanon's governing elites have remained largely unaffected by the wave of popular dissent in the Middle East that has toppled some of the region's authoritarian regimes and loosened the grip of others, leaving the country on the margins of the so-called Arab Spring, said Nadim Houry, Deputy Middle East director at the New York-based group.

    "The Lebanese government and parliament missed opportunities to advance human rights by sitting on, or rejecting, key reforms and proposal," Houry said at the release of Lebanon section of HRW's annual report. He urged lawmakers to establish a mechanism to visit and monitor detention sites in which former prisoners allege abuses and torture occurred, and amend laws that discriminate against women.

    "Discriminatory provisions that significantly harm and disadvantage women continue to exist in personal status law, determined by an individual's religious affiliation, the group said. Women suffer from unequal access to divorce, and if it is granted, are often discriminated against in child custody proceedings.

    Unlike men, Lebanese women cannot pass their nationality to foreign husbands and their children, and they also suffer discrimination in inheritance laws, the group said.

    Tired of text ads? Want to put a little more sparkle into your marketing? When it comes to branding your business online, banner ads have a lot of advantages over search marketing. However, good creative is a key ingredient in a successful display ad campaign.

    Google offers a tool as part of the AdWords platform called the Ad Builder. Here is a look at the good, the bad, and the ugly of using the Ad Builder to make a simple banner ad.

    How to Build an Ad

    As long as you want to just use a template to create an ad, the Ad Builder is pretty simple to use. For those that have a strong idea of what you want the ad to look like, it is possible to start with a blank slate.

    Personally, I am not a strong visual person, so I find it beneficial to start with a template as a guide. There are a lot of templates to choose from, although many of these are very cheesy. For demonstration purposes, the following steps are for customizing based on a very simple template.

    Step 1: Launch the Display Ad Builder

    After you set up a campaign, go into the Ads tab. Under the ?New Ad? option, select ?Display ad builder? from the drop down menu.

    Step 2: Choose a Template

    Look through the menus for a template style that matches what you want.

    Different templates offer different amounts of customization, so spend a little time opening up different ones and looking at what options can be changed, or whether the drop down menu for new content is showing at the top of the editing window.

    Here is a look at the different parts of the main Ad Builder interface:

    Step 3: Add Text

    Display ads have the advantage of incorporating both text and images. Keeping with the theme of this article, I use a headline of ?Display Advertising.? Then, in the description box, I type in a catchy slogan to go along with my ad.

    This does not fit well in all ad formats. I switch between the views and tweak the size and shape of the box on each one so that the text fits okay.

    Step 4: Add Graphics

    For the logo, I am going to use our own company graphics. So I choose ?My computer? under ?Select another image.?

    While I?m at it, I update the call to action button.? This was somewhat frustrating.? Some templates limit your ability to tweak positioning of items like the button. Also, there is no way to measure positioning of objects, so you have to be careful with spacing and centering. It would be nice to have a snap-to-grid type of feature.

    For the main image, I decide to use an image from the stock photo gallery.

    I do a keyword search on ?picture? and come up with this one.

    The Ad Builder will show a slice of the image based on the ad format. Sometimes it comes out just fine, like this one:

    But sometimes you have to nudge it to show a good slice.

    Once again, the drag-and-drop interface gives some control over the crop. For some reason, I was not able to change the zoom level from this screen, even though there is a toggle in the lower right hand corner.

    Be sure to check how the ad looks in each of the formats. Remember, you don?t have to use every single format. But, the more formats you use, the more websites you will be able to place the ad on.

    You can do adjustments on the ?select ad sizes? page, allowing you to view all the formats in one place simultaneously. After making the big choices, I go through and tweak each size ad to get the best positioning of the elements. Here are the finished versions:

    Check and double check for errors. See my mistake above with capitalization of ?AdWords?? Note that by default Google includes a little section at the lower left hand corner of the ad for a Google +1 button.

    In their support documentation, they note that it is important not to design an ad that has important features (like your logo) in the bottom 20 percent of the space. More specifically, the button is 15-24 pixels in height. What are people +1-ing when they click the button? The ad itself.

    How to get rid of the +1 button: You won?t see the +1 button until after you save the ads. To remove them, you have to be in the main AdWords dashboard. For the Google Display Network, here are the steps they provide:

    1. Sign in to your AdWords account at?https://adwords.google.com.
    2. Click the?Campaigns?tab, then click the campaign you want to edit.
    3. Click the?Settings?tab.
    4. Click?Advanced settings > Social Settings?to change your ad sharing preferences.

    If the ads are running within the Google Search Network you are not able to opt out of the button.

    Final Step

    Once you are finished, you save the ad and are taken back to the familiar campaign dashboard.

    You can view the finished creative by clicking on ?View full size display ad.? This also gives you an option to share the ad preview by generating a link that you can copy and paste. The ad you created will have a status of ?Under review.?

    According to Google, this process normally takes up to three business days. Each format will show up as a separate ad, which makes sense since you can actually put completely different graphics and copy on each one.

    Ad Builder Shortcomings

    The animation controls are where the tool is most limited. On most templates, you can set how each element appears by selecting an appearance effect such as fade in, float in, fly in, zoom in, shrink in, and drop in. Controls on these are duration, delay, and direction (left, right, top, and bottom). The Ad Builder does not offer control over exit animations, so once an element plops in it stays to the end. So what this allows is the gradual buildup of a final image by adding elements over a short period of time.

    There is no way to create your own slide show or other serial image presentation other than through the templates that have it built in, like the ?Product Showcase? templates. Also, there are no drawing tools, so you would have to make any extra objects that you want- like edge frames, arrows, or boxes?in another program like Photoshop and upload them as separate images.

    Lastly, the animations are simplistic, which could be very frustrating to the more graphically inclined user.

    Another shortcoming of the Ad Builder is that it does not offer any way to save an ad that you have created yourself and use it as a template for new ads. It is possible to take an ad that you created for one campaign and copy it over to a new campaign.

    Once you do so, you can make a few tweaks to update the ad for the new objectives. Note that you now have to select all the ads before clicking the edit button if you want to make changes to the whole group

    Final Thoughts

    No matter what tool you use to build your banner ads, good graphics are key. Google offers stock photos, but this has a tendency to make your ad look rather generic. There is no quick replacement for having strong visual assets designed just for your brand.

    The ad builder tool offers the ability to upload images from your computer, use stock photos, or it will fetch images from your website. I like this last option. If you have already put a lot of resources into making a great website, you can quickly put that to use. Ads that match the destination site are shown to be more effective.

    It would be really helpful if Google provided data on how each element performs. For example, the call to action buttons?what happens if you change the size, the color, the drop shadow effect, etc.? I was not able to find information on the number of ads built using this tool, but they surely have a?sizable?amount of data that could provide insights on creative optimization.

    What can you do with your ad once you have built it? You can run it on GDN (Google Display Network), of course. But you can?t exactly download the final files and Google does not give you the tags that would identify where to locate the ads on its ad server.

    At my firm, we find that hyper-local campaigns have to run on many networks besides just the GDN in order to get enough exposure, so the display ad builder is not really a good solution for us. Plus, our creative team finds the animation options far too limiting. But for a small online business that wants to go beyond text ads, you can build a decent banner ad with the Google Display Ad Builder.

    Stocks slip as earnings fail to inspire investors

    NEW YORK (AP) ? Stocks are edging lower on Wall Street as the latest round of earnings reports failed to give investors an impetus to push a recent rally forward.

    The Dow Jones industrial average was down seven points at 13,973 as shortly before noon Wednesday.

    The Standard & Poor's 500 was off less than a point at 1,510. The Nasdaq composite fell a fraction to 3,170.

    Time Warner rose after its net income grew 51 percent. Marathon Oil fell after its net income declined 41 percent on higher exploration costs and taxes.

    Stocks are consolidating their gains after surging since the start of the year. The Dow closed above 14,000 for the first time since December 2007 Friday and had its best January in almost two decades.

    Chris Brown may face changes to his probation

    More trouble for Chris Brown. The Los Angeles District Attorney is moving to modify the singer's probation, alleging the star failed to provide "credible, competent or verifiable evidence" that he completed his court ordered community service.

    Brown was ordered to complete 180 days of community labor after his 2009 brutal attack on Rihanna as part of his five-year probation sentence for assault.

    The "Look at Me Now" singer previously had permission from the court to complete the service hours in his home state of Virginia, but now, the Los Angeles Deputy District Attorney is asking the court to order Chris to fulfill his obligation in Los Angeles County.

    Deputy District Attorney Mary Murrary filed a 19-page motion Tuesday, claiming there are "significant discrepancies" in the reports submitted by Richmond, Va., police as proof that Breezy performed six-months of community labor. She says the records in question are "at best sloppy documentation and at worst fraudulent reporting."

    In September, Brown tested positive for marijuana?and although his probation was not revoked, the D.A. asked the singer to somehow verify his community service hours after he told the court he completed most of the work alone and "didn't sign in."

    The R&B star has also been making headlines as of late for his alleged brawl?with Frank Ocean, and although their supposed altercation was mentioned in the motion, it is not connected to Brown's alleged probation violation.

    Brown currently remains on probation for hitting on-again girlfriend Rihanna in 2009.

    Mexico seeks culprits in rape of 6 tourists

    ACAPULCO, Mexico (AP) ? Authorities have information they hope will lead them to the gang of armed, masked men who raped six Spanish tourists in the Mexican resort of Acapulco, the attorney general in the southern state of Guerrero said.

    The vicious, hours-long attack at a beach home on the outskirts of Acapulco before dawn Monday was the latest chapter of violence that has tarnished the once-glamorous Pacific coast resort celebrated in Frank Sinatra songs and Elvis Presley movies.

    "Fortunately we have strong evidence to lead us to those responsible for this reprehensible act," Guerrero state Attorney General Martha Garzon Guzman told Mexico's Radio Formula on Monday.

    The beach home on an idyllic stretch of coastline had been rented by six Spanish men, six Spanish women and a Mexican woman.

    The attackers gained access to the house because two of the Spaniards were in the yard and apparently were forced to open the door, Acapulco Mayor Luis Walton told a news conference late Monday.

    The five attackers burst into the house and held the group at gunpoint, he said. They tied up the six men with phone cords and bathing suit straps and then raped the six Spanish women. The Mexican woman was not raped.

    Garzon said the Mexican woman begged the men not to rape her and the assailants told her they would spare her because she is Mexican.

    The attack began on Monday about two hours after midnight and the victims were only able to report the crime five hours later, at nearly 7 a.m.

    "This is a regrettable situation, and of course it is going to damage Acapulco," Walton said.

    The once-glittering resort that attracted movie stars and celebrities in the 1950s and 60s has already been battered by years of drug gang killings and extortions, but except for very few incidents, the violence has not touched tourists.

    Walton said he believed, but wasn't sure, that the assailants in Monday's attack didn't belong to a drug gang. Garzon said witness descriptions of the attackers were more difficult to obtain because they wore masks.

    "From what the attorney general has told me, I don't think this was organized crime," Walton said. "But that will have to be investigated, we don't know."

    Mexico's Foreign Relations Department issued a statement saying it regretted the attack.

    "Up to now, the investigations are being carried out by local authorities and they will be the ones to provide information," the statement said.

    In Mexico, it's up to local authorities to determine if organized crime is behind an attack, and, if so, turn the case over to federal authorities.

    Security and drug analyst Jorge Chabat said that, after years of drug gang activity in Acapulco, the distinction may be merely semantic.

    "At this point, the line between common and organized crime is very tenuous, there are a lot of these gangs that take advantage of the unsafe situation that currently exists, they know the government can't keep up," Chabat said. "

    The Spanish Embassy in Mexico City said the victims were receiving consular assistance.

    The victims were "psychologically affected" by the attack and received treatment, the mayor said.

    Spain's Foreign Ministry had already issued a travelers advisory on its website for Acapulco before the Monday attack, listing the resort as one of Mexico's "risk zone," though not the worst.

    "In Acapulco, organized crime gangs have carried out violence, though up to now that has not affected tourists or the areas they visit," the advisory states. "At any rate, heightened caution is advised."

    The attack came just three days after a pair of Mexican tourists returning from a beach east of Acapulco were shot at and slightly wounded by members of a masked rural self-defense squad that has set up roadblocks in areas north of Acapulco, to defend their communities against drug gang violence.

    The vigilantes say the Mexican tourists failed to stop at their improvised roadblock.

    Walton said the city was already contemplating ways to revive the city's image.

    "We have to look at an advertising campaign to say that not everything in Acapulco is like that," Walton said. "This happens everywhere in the world, not just in Acapulco or in Mexico."

    The attack came just four days after Tourism Secretary Claudia Ruiz Massieu visited the International Tourism Fair held in Madrid to launch a "promotional offensive" depicting Mexico as a safe and attractive destination.

    "This is Mexico's moment," Massieu said, describing it as "a safe country."

    Acapulco is the granddaddy of Mexican resorts. Elizabeth Taylor was married there, John F. and Jackie Kennedy came on their honeymoon, and Howard Hughes spent his later years hiding out in a suite at the Princess Hotel, a pyramid-shaped icon in the exclusive Punta Diamante, or Diamond Point, zone.

    Beheadings and drug gang shootouts, some on the city's main seaside boulevard, became more frequent after 2006, as gangs fought for control of the city's drug and extortion business.

    3 Super Bowl Ads That Look an Awful Lot Like Other Ads

    Allegations of idea appropriation are nothing new in advertising. However, when the stakes are as high as they are as in the Super Bowl, the charges have a bit more weight.

    Thanks to YouTube, the accusations began well before the game as Lee Garfinkel, the chairman of Havas Worldwide NY, noted the similarities between an ad he worked on in the '90s and Taco Bell's Game Day ad. The other two ads were called to task almost immediately, thanks to social media.
